Legislation
The landscape profile has, by way of the new Territory Planning and Landscape Protection legislation (Law of June 30th 2004), become very relevant in comparison to previous legislation, including specific landscape studies in Territorial Planning, General Plans and planning tools which will foresee urban growth (PAI’s).
Acoustic impact studies and the precepts of property and water availability related to environmental projects also stand out for having to be put into practice. Moreover, the coming into effect of the future law regulating golf courses, in response to the growing demand for such facilities in the Autonomous Region of Valencia, will require a new set of technical documents associated to their management and establishment.
Part of the legislation currently in force which GEOZONE is based on for the elaboration of mandatory binding studies, is the following:
- Decree 120 of August 11th 2006, the Council, which approves the Landscape Regulations of the Valencian Community.
- Decree 67 of May 12th 2006, the Council, which approves Regulations on Territorial and Urban Planning Management.
- Law 2 of May 5th 2006, Pollution Prevention and Environmental Quality.
- Law 9 of April 28th 2006, on the evaluation of the effects of certain plans and programs on the environment.
- Law 10 of April 28th 2006, amending Law 43 of November 21st 2003, Forestry.
- Law 16 of December 30th 2005, Urban Law of Valencia.
- Decree 82 of April 22nd 2005, the “Generalitat” Council, Environmental Management of Mining in forest areas of the Autonomous Region of Valencia.
- Order of January 3rd 2005, the Ministry of Land and Housing, for the establishment of the minimum environmental impact content in the studies to be dealing with this Ministry.
- Law 10 of December 9th 2004, Soil not able to be built on.
- Law 4 of June 30th 2004the “Generalitat”, Territorial Planning and Landscape Protection.
- Decree 98 of 1995, which approves the Regulation of Law 3 of December 9th 1993, for the Forest of Valencia.
